I’mPossible Wellness Viewer Terms of Service Agreement

Welcome to I’mPossible Wellness. Please read these Terms of Service Agreement ("Agreement") carefully before accessing or using our On Demand Fitness service ("Service"). This Agreement sets forth the legally binding terms and conditions for your use of the Service

provided by I’mPossible Wellness.

1. Acceptance of Terms

By accessing or using the I’mPossible Wellness Service, you agree to be bound by this Agreement and all terms incorporated herein by reference. If you do not agree to these terms, please do not use the Service.

2. Description of Service

I’mPossible Wellness provides an O nDemand platform for users to access Health & Wellness programming and fitness workouts led by certified I’mPossible Wellness instructors ("Instructor"). The Service includes video content, instructional materials, and any additional features or content provided by I’mPossible Wellness.

3. Access and Use

a. Age Requirement: You must be at least 18 years old or the legal age of majority in your jurisdiction to use the Service.

b. Account: In order to access certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are

responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

c. License: I’mPossible Wellness grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes only.

d. Prohibited Conduct: You agree not to engage in any of the following prohibited activities:

i. Copy, distribute, or modify any part of the Service without prior written authorization from I’mPossible Wellness.

ii. Use the Service for any unlawful purpose or in any manner that violates this Agreement.

iii. Attempt to access any restricted areas of the Service without authorization.

iv. Interfere with or disrupt the Service or servers or networks connected to the Service.

4. Intellectual Property

All content included in the Service, including but not limited to videos, text, graphics, logos, and images, is the property of I’mPossible Wellness or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of such content without prior written authorization.

5. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. I’mPossible Wellness does not warrant that the Service will be uninterrupted or error-free, or that any defects in the Service will be corrected.

6. Limitation of Liability

In no event shall I’mPossible Wellness its officers, directors, trainers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, arising out of or in connection with your use of the Service.

7. Indemnification

You agree to indemnify, defend, and hold harmless I’mPossible Wellness, its affiliates, and their respective officers, directors, trainers, employees, and agents, from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or in connection with your use of the Service or violation of this Agreement.

8. Modifications to Service or Agreement

I’mPossible Wellness reserves the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. I’mPossible Wellness may also revise this Agreement at any time by posting the updated terms on the I’mPossible Wellness website. Your continued use of the Service after such changes will constitute your acceptance of the revised Agreement.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law principles.
